Draft Section 4(f) Evaluation

The Federal Transit Administration (FTA), in cooperation with the Southeastern Pennsylvania Transportation Authority (SEPTA), is providing the Draft Section 4(f) Evaluation for the King of Prussia Rail Extension (Project) to the US Department of the Interior (DOI) and other officials with jurisdiction in accordance with the requirements of Section 4(f) of the US Department of Transportation (USDOT) Act of 1966 (49 USC 303), hereinafter referred to as “Section 4(f),” and its implementing regulations codified at 23 CFR Part 774.5(a).

A Draft Section 4(f) Evaluation for the Project was included in the October 17, 2017 King of Prussia Rail Extension Draft Environmental Impact Statement (DEIS), and was subject to public and US Department of the Interior (DOI) review during the DEIS public comment period (October 17, 2017 to December 8, 2017). Because a new Section 4(f) property was identified after the DEIS was published, FTA is re-issuing the Draft Section 4(f) Evaluation for public and DOI review in compliance with 23 CFR 774.5(a). FTA provides notification of its intent to make a de minimis impact determination in the Draft Section 4(f) Evaluation (23 CFR 774.5(b)). The Draft Section 4(f) Evaluation identifies properties that are protected by Section 4(f) and evaluates the potential use of these properties. No DOI administered properties would be impacted as a result of the Project.
